Terms of Service.

These Terms of Service ("Terms") govern your access to and use of the CreatorsBay website and mobile apps (the "Platform"), operated by Concept Crafters, a Partnership firm registered in India ("Concept Crafters", "we", "us"). By creating an account or using the Platform you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract. If you use the Platform on behalf of a business, you confirm you are authorised to bind that business.

2. Definitions

• Creator / Influencer — a user who offers content-creation or promotional services.
• Brand — a user who runs campaigns and engages Creators.
• Campaign / Deal — an engagement between a Brand and a Creator arranged through the Platform.
• Wallet — the in-app balance used to fund campaigns and receive earnings.

3. Nature of the Platform

CreatorsBay is an online intermediary and marketplace that helps Brands and Creators discover each other and transact. The contract for any campaign or content is between the Brand and the Creator. Concept Crafters is not a party to that contract and does not guarantee the conduct, performance, content, or results of any user. We act as an intermediary under the Information Technology Act, 2000.

4. Accounts

You agree to provide accurate information, keep your credentials secure and be responsible for all activity under your account. Notify us immediately of any unauthorised use. We may verify your identity (KYC) and may suspend or limit accounts that fail verification.

5. Creator Obligations

• Use genuine social-media accounts and provide accurate follower/engagement information; do not use fake followers, bots or fraudulent engagement.
• Deliver the agreed content on time and to the agreed specification.
• Comply with applicable advertising laws and disclosure guidelines, including the ASCI guidelines and platform rules on disclosing paid partnerships.
• Maintain valid KYC and payout details to receive withdrawals.

6. Brand Obligations

• Run lawful campaigns with accurate briefs and lawful products/services.
• Fund campaigns and pay agreed amounts and fees through the Platform.
• Not request unlawful, misleading or harmful content.

7. Payments, Wallet & Fees

• Payments and payouts are processed by Razorpay. By transacting you also agree to Razorpay's terms.
• Brands add funds to their Wallet to fund campaigns. Funds allocated to a deal may be held by the Platform until the deal is completed or resolved.
• CreatorsBay charges a service fee / commission on transactions, shown to you before you confirm. Applicable taxes may apply.
• Creators receive earnings in their Wallet and can request withdrawals to their verified UPI/bank account, subject to KYC and minimum thresholds.
• You are responsible for your own taxes (including any GST/TDS) arising from your use of the Platform.

8. Cancellations, Refunds & Disputes

Cancellations, refunds and dispute handling are governed by our Refund & Cancellation Policy. Where a Brand and Creator dispute a deal, we may, at our discretion, review the matter and decide whether to release or refund held funds. Our decision in such cases is final for the purpose of releasing Platform-held funds, without prejudice to your other legal rights.

9. Prohibited Conduct & Content

You must not use the Platform to: post unlawful, infringing, obscene, defamatory, hateful or misleading content; impersonate others; spam or harvest data; circumvent fees or take transactions off-platform to avoid fees; introduce malware; or violate any law or third-party right. We may remove content and suspend accounts that breach these Terms.

10. Intellectual Property & User Content

The Platform, its software, design and trademarks are owned by Concept Crafters or its licensors. You retain ownership of content you create, and you grant us a limited licence to host and display it to operate the Platform. You are solely responsible for content you upload and confirm you have the rights to it. Licensing of campaign deliverables between a Brand and Creator is governed by their deal terms.

11. Reviews

Reviews and ratings must be honest and based on a genuine transaction. We may remove reviews that violate these Terms.

12. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Concept Crafters is not liable for indirect, incidental, special or consequential damages, or for the acts, content or omissions of any user. Our total aggregate liability arising out of or relating to the Platform shall not exceed the total Platform service fees you paid to us in the three (3) months preceding the event giving rise to the claim.

13. Indemnity

You agree to indemnify and hold harmless Concept Crafters, its partners and personnel from any claim or demand arising out of your use of the Platform, your content, or your breach of these Terms or any law or third-party right.

14. Suspension & Termination

You may stop using the Platform and delete your account at any time (see Account & Data Deletion). We may suspend or terminate access for breach of these Terms, suspected fraud, or to comply with law. Provisions that by their nature should survive termination will survive.

15. Mobile Applications & App Stores

You obtain our apps through the Google Play Store and Apple App Store and must comply with their terms. The app stores are not responsible for the Platform or its content. For iOS, Apple is not a party to these Terms but is a third-party beneficiary entitled to enforce them, and any app-related support and warranty obligations are ours, not Apple's.

16. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to any binding arbitration agreed in writing, the courts at Nashik, Maharashtra, India shall have exclusive jurisdiction. Before initiating formal proceedings, please contact our Grievance Officer so we can try to resolve the matter.

17. Changes to These Terms

We may update these Terms from time to time. We will revise the "Effective" date above and, for material changes, provide notice in-app or by email. Continued use after an update means you accept the revised Terms.
